Panel Title: Indecent Proposals: The FCC's Struggle to Regulate Indecency and Violence on Television
Panel Description: Recent cases in the U.S. federal courts have dealt with the FCC's attempts to enforce indecency rules on fleeting expletives (see Fox Television Stations, Inc. v. F.C.C., 489 F.3d 444, 2007; and F.C.C. v. Fox Television Stations, Inc., 2009). The debate has called attention to the FCC's broader effort to regulate indecency, as well as its 2007 report in which the FCC asked Congress for guidance on how the agency might regulate violence on television. For this panel I am seeking presentations addressing FCC action on indecency and/or violence on television and analyses of recent federal court jurisprudence on broadcast indecency regulations. The panel organizer will present an analysis that considers the legality of applying the FCC’s safe harbor provision to television violence.
